Acceptable Use Policy

2. Fraud and Unlawful Activity

2.1. You must not use GiveWheel to commit, facilitate or conceal fraud, financial crime or any other unlawful activity.

2.2. Prohibited activities include, without limitation:

1. misrepresenting your identity, affiliation or authority;
2. impersonating another person or organisation;
3. providing false, inaccurate or misleading information;
4. creating or operating a fundraising page under false pretences;
5. misleading Donors, Fundraisers, Beneficiary Organisations, bidders, entrants or event attendees;
6. misusing another person's payment method, Account or personal information;
7. making or attempting to make unauthorised payments;
8. laundering money or attempting to conceal the source or destination of funds;
9. evading or circumventing financial sanctions or other legal restrictions;
10. attempting to circumvent GiveWheel's verification, compliance, fraud-prevention or security procedures; or
11. assisting or encouraging another person to engage in any of the activities above.

2.3. We may delay, suspend, restrict or withhold activity or payments where reasonably necessary to investigate suspected fraud, unlawful activity, sanctions concerns, payment disputes or other compliance risks.

3. Fundraising Standards

3.1. Fundraisers are responsible for ensuring that information published through their fundraising pages and campaigns is accurate, truthful and not misleading.

3.2. Fundraising pages must accurately represent, where applicable:

1. the purpose of the fundraising;
2. the Fundraiser or organisation conducting the fundraising;
3. the Beneficiary Organisation or Beneficiary Organisations benefiting;
4. how Donations will be allocated where more than one Beneficiary Organisation is supported;
5. any Prize, incentive, reward or other benefit being offered; and
6. any material conditions or restrictions relating to the fundraising activity.

3.3. You must not knowingly publish or communicate inaccurate, deceptive or materially misleading fundraising information.

3.4. You must not use GiveWheel to raise or collect funds for a purpose or Beneficiary Organisation that is not permitted by GiveWheel or that you do not have the appropriate authority to support.

3.5. If you become aware that information relating to your fundraising activity is materially inaccurate or misleading, you must take reasonable steps to correct it promptly.

4. Prohibited Content

4.1. You must not upload, publish, transmit or otherwise distribute content through GiveWheel that:

1. is unlawful or encourages unlawful activity;
2. is fraudulent, deceptive or materially misleading;
3. is defamatory or unlawfully infringes another person's rights;
4. is threatening, abusive or intended to harass or intimidate another person;
5. promotes hatred or discrimination against a person or group on the basis of a protected characteristic;
6. promotes violence, terrorism or serious criminal activity;
7. contains sexually explicit or obscene material where such material is not permitted by the relevant GiveWheel service;
8. contains malware, viruses, malicious code or other harmful material;
9. infringes another person's intellectual property, privacy or other legal rights; or
10. is otherwise reasonably likely to cause significant harm to users, Beneficiary Organisations, GiveWheel or the integrity of the Platform.

4.2. We may remove, restrict access to or disable content where we reasonably believe that it breaches this Policy, the Terms or applicable law.

5. Intellectual Property

5.1. You must not upload, publish or distribute material through GiveWheel unless you have the necessary rights, permissions or licences to do so.

5.2. You must not use GiveWheel to infringe, misappropriate or otherwise violate another person's intellectual property rights.

5.3. You must not copy, reproduce, modify, distribute, commercially exploit, reverse engineer, decompile, disassemble or create derivative works from any part of the GiveWheel Services except where expressly permitted by the Terms, applicable law or GiveWheel's prior written permission.

5.4. GiveWheel may remove content or restrict access to content where we receive a credible allegation of intellectual property infringement or reasonably believe that infringement has occurred.

6. Platform and System Security

6.1. You must not use GiveWheel in a manner that compromises, threatens or interferes with the security, availability or integrity of the Platform or any system connected to it.

6.2. Prohibited activities include:

1. attempting to gain unauthorised access to GiveWheel systems, Accounts, networks or infrastructure;
2. accessing or attempting to access another user's Account without authorisation;
3. bypassing or attempting to bypass authentication, access controls or other security measures;
4. introducing, transmitting or distributing viruses, malware or other malicious code;
5. deliberately disrupting, damaging or interfering with the Platform;
6. conducting denial-of-service or similar attacks;
7. testing, scanning or probing GiveWheel systems or networks for vulnerabilities without GiveWheel's prior written permission;
8. monitoring or intercepting network traffic without authorisation; or
9. using or distributing tools, code or techniques intended to compromise the security of GiveWheel or another person's systems.

6.3. If you identify a potential security vulnerability or security incident affecting GiveWheel, you should report it to us promptly and must not exploit or disclose the vulnerability in a manner that could cause harm.

7. Automated Access, Scraping and Service Resources

7.1. Unless expressly authorised by GiveWheel, you must not use bots, scripts, crawlers, scraping tools or other automated means to access, collect or copy information from GiveWheel.

7.2. You must not:

1. scrape or systematically copy Platform content;
2. systematically extract, reproduce or republish GiveWheel data;
3. use automated systems to create Accounts, fundraising pages, Donations, entries, bids or other transactions without authorisation;
4. deliberately overload or place unreasonable demands on the Platform or its infrastructure;
5. conduct denial-of-service attacks or similar activity; or
6. otherwise interfere with the normal operation or availability of GiveWheel.

7.3. Reasonable indexing by recognised search engines is permitted, provided that it does not circumvent technical restrictions or materially interfere with the Platform.

8. Communications and Misuse of Personal Information

8.1. You must not use GiveWheel to:

1. send spam or unsolicited bulk communications;
2. conduct phishing or other fraudulent communications;
3. distribute deceptive or misleading messages;
4. harvest, collect or compile personal information about other users without a lawful basis or appropriate permission;
5. use another person's personal information without authorisation;
6. impersonate another person or organisation; or
7. disclose personal information relating to another person except with their consent or where otherwise permitted or required by law.

8.2. You are responsible for ensuring that communications you send through GiveWheel comply with applicable laws and do not constitute harassment, fraud, spam or other prohibited conduct.

9. Account Security

9.1. You are responsible for taking reasonable steps to protect your Account and login credentials.

9.2. You must not:

1. share your password or authentication credentials with an unauthorised person;
2. permit another person to access your Account in a manner that compromises its security;
3. use another person's Account without authorisation; or
4. knowingly allow your Account to be used for prohibited or unlawful activity.

9.3. You must notify GiveWheel promptly if you believe that your Account or credentials have been compromised or used without authorisation.

9.4. GiveWheel may suspend or restrict an Account where we reasonably believe that it has been compromised or is being used in breach of this Policy or the Terms.

10. Reporting Violations

10.1. If you believe that content, activity or conduct on GiveWheel breaches this Policy, the Terms or applicable law, you should report it to GiveWheel as soon as reasonably practicable through our support or contact channels.

10.2. Where appropriate, we may investigate reported violations and take action in accordance with this Policy and the Terms.

10.3. We do not guarantee that every report will result in the removal of content, suspension of an Account or other enforcement action.

11. Enforcement

11.1. Where we reasonably believe that you have breached this Policy or the Terms, we may take any action that we reasonably consider necessary and proportionate to protect GiveWheel, its users, Beneficiary Organisations or third parties.

11.2. Such action may include:

1. removing, restricting or disabling access to content;
2. issuing a warning;
3. requiring corrective action;
4. suspending or terminating an Account;
5. suspending or removing a fundraising page or campaign;
6. restricting access to particular GiveWheel Services;
7. cancelling or restricting participation in an event, Competition or Auction where permitted by the applicable terms;
8. delaying, withholding, refunding or restricting payments where reasonably necessary and permitted under the Terms or applicable policy;
9. preserving relevant information for investigation;
10. referring suspected unlawful activity to law enforcement, regulators or other relevant authorities; or
11. taking any other action permitted under the Terms or applicable law.

11.3. We may take action without prior notice where we reasonably believe that immediate action is necessary to prevent fraud, unlawful activity, security risks, harm to users or Beneficiary Organisations, or other significant risk.

11.4. Where reasonably practicable, we will explain the reasons for enforcement action taken against you, subject to legal, security, fraud-prevention and confidentiality considerations.

11.5. We reserve all rights and remedies available to us under the Terms and applicable law.

12. Relationship with the Terms

12.1. This Policy forms part of the Terms and is incorporated into them by reference.

12.2. A breach of this Policy constitutes a breach of the Terms.

12.3. If there is any conflict between this Policy and the Terms, the Terms will prevail unless the Terms expressly state otherwise.

12.4. Additional terms may apply to particular GiveWheel Services, including, but not limited to, Ticketed Events, Competitions, and Auctions. Where those additional terms contain specific rules relating to acceptable use or prohibited conduct, those rules will also apply.

13. Changes to This Policy

13.1. We may update this Policy from time to time to reflect changes to GiveWheel, applicable law, regulatory requirements, security risks or industry standards.

13.2. Where we make material changes, we will provide reasonable notice through the Platform, by email or by another appropriate means where reasonably practicable.

13.3. The updated Policy will take effect from the date specified in the updated version.

13.4. Your continued use of GiveWheel after the updated Policy takes effect constitutes acceptance of the updated Policy, subject to any rights you may have under applicable law.
